A lot is new since ACOEM published a “joint” guidance statement on Marijuana in the Workplace: Guidance for Occupational Health Professionals and Employers with AAOHN in 2015. As the laws surrounding the use of marijuana and other cannabinoids continues to change, the ability of the occupation health professional to handle related issues continues to become murkier, whether as a corporate medical director/advisor, a worker’s compensation provider, an examiner, a Medical Review Officer, or any other health care role providing services to employers. In the past, the “we mirror federal law to the extent possible” was an easy solution, but now with conflicting state and federal laws, it is important that occupational health professional understand how employers may address cannabinoids and where the issues may be going.

This webinar will review evolving marijuana laws as they relate to the workplace. Current federal law and the impact of the 2018 Agriculture Improvement Act (Farm Bill) will be discussed as will examples of state laws and statutes which may limit what employers may do or may set new requirements for users of marijuana whether medical or recreational. Considerations including safety-sensitive positions and defining impairment will be reviewed. Participants will be provided with resources to attempt to stay current or explore the topic in more detail.

This activity includes the following:
1. Educational Content
2. Comprehensive Post-test

The medium or combination of media used for this activity will be audio and video. Participants will view the pre-recorded webinar while listening to the audio. A self-assessment post-test will then be taken online, which will be submitted to ACOEM. Participants who answer at least 4 out of 5 questions correctly will be eligible to claim up to 1.0 AMA PRA Category 1 Credit™. This activity is an ABPM-approved LLSA/MOC Activity.

Learning Objectives:
1. Describe the current federal law on marijuana and the impact of the 2018 Agriculture Improvement Act. (Farm Bill).
2. Identify several examples of state laws and statutes which may limit what employers may do or may set new requirements for users of marijuana (medical or recreational).
3. Recognize safety-sensitive positions and determine ways to define impairment.
